The High Court of Kerala on Monday has given conditional bail to Franco Mulakkal after he was arrested over allegations of repeatedly harassing and assaulting a nun sexually for over years.
The bail was given on the condition that the accused Franco Mulakkal should surrender his passport and the judge Raja Vijayaraghavan of Kerala High Court also directed the accused not to enter the state of Kerala except for appearing before the probe officer once in two weeks only on Saturdays. This condition on which Franco Mulakkal was given bail is applicable till a charge sheet is filed in the case.
Two weeks ago the High Court of Kerala has dismissed the bail plea of the Bishop Franco Mulakkal on the reason that; since the accused holds a high position in the society, he may try to influence the witness in the case as mentioned by the prosecution in their argument.
The 54 year old Franco Mulakkal is presently in a sub jail in Pala in Kottayam district, was moved to the High Court of Kerala after the Magistrate court extended his judicial remand. The Police also opposed the bail application of the accused citing that the investigation in the case is still on.
The nun filled a complaint in the Kottayam Police station in June 2018 alleging Franco Mulakkal, a Roman Catholic Bishop that he had sexually abused her at a guest house in Kuravilangad in May 2014 and later he also harassed and assaulted her sexually multiple times. The nun in her complaint said that though she approached the church authorities many times before with this complaint on the Bishop, they have not taken any required action on the Bishop Franco Mulakkal.
However, Franco Mulakkal has been continuously denying the allegations made by the nun as baseless and concocted. He also went on record saying that the nun has made those allegations as the Catholic order had rejected her demands for favours. These allegations on the Bishop Franco Mulakkal have made him to step aside as the Bishop of the Jalandhar Diocese.
