In a notable courtroom observation, the Supreme Court on Monday remarked that caution must be exercised in pre-marital physical relationships, stating that a boy and a girl are strangers before marriage.
The oral observation was made while hearing a bail application filed by a man accused of rape on the alleged false promise of marriage.
The matter was heard by a bench comprising Justice BV Nagarathna and Justice Ujjal Bhuyan.
Background of the Case
According to court proceedings, the complainant, a woman around 30 years of age, stated that she met the accused on a matrimonial platform in 2022. The accused allegedly assured her that he would marry her. Based on this promise, she entered into a relationship with him.
It has been alleged that the two had physical relations on multiple occasions in Delhi and later in Dubai. The complainant further claimed that she travelled abroad at his insistence.
Subsequently, she discovered that the accused was already married and had solemnised another marriage on 19 January 2024 in Punjab.
The woman has also alleged that during their time in Dubai, intimate videos were recorded without her consent and that she was threatened with their circulation.
Supreme Court’s Observation
During the hearing, Justice BV Nagarathna made the following oral remark:
“Maybe we are old-fashioned, but before marriage, a boy and a girl are strangers. Whatever may be the thick and thin of their relationship, we fail to understand how they can be indulging in a physical relationship before marriage. Maybe we are old fashioned…You must be very careful, nobody should believe anybody before marriage.”
The bench also questioned the circumstances under which the complainant travelled to Dubai.
Justice Nagarathna further observed: “She should not have gone before marriage if she was so strict about it. We will send them to mediation. These are not cases which are to be tried and convicted when there is a consensual relationship.”
The Court indicated that mediation could be explored, noting that such cases involving consensual relationships may not always be suited for trial and conviction.
Previous Court Proceedings
Earlier, both the sessions court and the Delhi High Court had rejected the accused’s bail applications in 2025.
On 18 November 2025, the Delhi High Court dismissed the bail plea, observing that prima facie the promise of marriage appeared false from the beginning, especially since the accused was already married and later entered into another marriage in January 2024.
The matter has now been listed for further hearing to explore the possibility of settlement.
