With the arrival of the Coldplay concert in India, issues related to ticket selling, particularly ticket touting and the legal issues which surround it have come into the picture.

What is Ticket Scalping?

Ticket touting, also known as Ticket Scalping is the process by which individuals acquire tickets to certain events with the express intention of making a gain by selling those tickets, usually at much higher prices than which they were purchased for. The scalpers, unfortunately, engage the bots to buy the tickets the moment they are out there on sale while genuine fans are locked out of the market.

The Coldplay Concert Ticket Debacle

The use of ticket scalping has not been taken sparingly by the Coldplay concert in India either. According to sources, the tickets for the show in Mumbai were sold out in a matter of minutes and fans were left with no option but to rush online. However, many were locked out by prolific touts who were ready to pay high prices in order to purchase the tickets.

The Impact of Ticket Scalping

There are also many disadvantages of ticket scalping, for both the fans and the event owners. For fans, it means a massive combined bill of more than the ticket price and this is unattainable by most of them. Fans will feel let down and cheated because they will not be allowed to attend the concert. For the same reasons, other people will not be allowed to attend it.

From the perspective of the organizers of the events, ticket scalping is unpleasant and tends to harm the image of the events and reduce the confidence of the people. It also results in a loss of revenue that organizers could make from ticket sales; scalpers merely make a business of selling tickets at extortionate prices.

Legal Ramifications of Ticket Scalping in India

Ticket scalping has been provided a legal way by the Bharatiya Nyay Sanhita (BNS), the revised penal code of India. Although the BNS does not specifically mention ticket scalping, multiple sections of the BNS can be applied to fraudulent practices associated with tickets.

Section 172 of the BNS is concerned with cheating which can be applied where offenders pretend that tickets are available which they know are not or where they quote a price which they know is going to be impossible to meet. Other sections of Criminal law may include the following Section 182 of wrongful loss or destruction of property, Section 292, forgery and Section 297 using a forged document.

These sections give law enforcement agencies the legal ground to prosecute people who perpetrate fraud in as much as they involve ticket sale fraud including fake advertisements of tickets, fake tickets, and wrong ticket prices. The BNS enables police to prosecute such cases and assure victims of ticket scams a favorable outcome.

The Consumer Protection Act, 1986 also holds consumer protection laws to fight ticket scalping in India. According to this Act, ticket scalping may be construed as any deceptive trade practice because of false and misleading representations through price.

Nevertheless, relevant specific regulations or guidelines applicable to ticket sales in India around and particularly within the framework of the Consumer Protection Act are also available. It should be noted that these regulations may offer further consumer protection and deal with ticket scalping problems rather more directly.
